Defendent In Westport Sex Assault Case Loses Bid For Lower Bond

Brian McIntyre will stay incarcerated, but judge said he can file motion for reduced bond.

One of two men accused of sexually assaulting a woman in Westport in February was denied a reduction in bond Friday in state Superior Court in Stamford.

Brian Andrew McIntyre, who has been incarcerated since being arrested Feb. 22 by Westport Police, asked that his bond be reduced to $200,000 from $400,000.

Speaking on McIntyre's behalf, Stamford lawyer Howard A. Ehring told Judge Gary J. White that McIntyre has been unable to hire a lawyer because he can't access his assets while in jail.

Although Ehring represented McIntyre during a previous court appearance, he is no longer his attorney. Ehring agreed, however, to present McIntyre's request for a lower bond because he is still shown in court records as the defendant's lawyer.

McIntyre, 49, resides in Pleasantville, N.Y.

Ehring told White that at $200,000 McIntyre may be able to post bond.

Responding to the request, Senior Assistant State's Attorney Richard J. Colangelo Jr. told White McIntyre has no bonds to the community and has five felony convictions in other states.

Ehring told White that McIntyre owns land in Fairfield County and does work in this area. At McIntyre's arraignment, Walkley said he works as a self-employed advertising executive.

McIntyre is charged with first-degree sexual assault, first-degree unlawful restraint and interfering with an officer. His co-defendant, is charged with first-degree sexual assault, first-degree unlawful restraint and first-degree hindering prosecution.

In affidavits to obtain arrest warrants for the men, Westport Police alleged the pair met a woman in a Westport bar and took her to a house at 28 Stony Brook Road to celebrate the birthday of one of them.

Police said the alleged victim told them the men pulled off her pants and underwear and raped her. She said they took her cell phone away and refused to let her leave.

White declined to lower McIntyre's bond, but advised him he could file a motion with the court for a lower bond.

Larkin has been free since posting a $250,000 bond.

McIntyre will return to court May 13, which is when Larkin is next scheduled to appear.
